Nassau Traffic Court’s new DISTRACTED DRIVER EDUCATION PROGRAM
On July 7, 2016, Nassau County’s traffic court (Cooper Street)
initiated a new policy which is called the
DISTRACTED DRIVER EDUCATION PROGRAM.
This policy pertains to how cell phone tickets, texting tickets, and
electronic device tickets will be handled by the traffic court.
Below are the new rules that are now in place.
IF YOU ARE CHARGED WITH PROHIBITED USE OF A CELL PHONE
OR ELECTRONIC DEVICE WHILE DRIVING, YOU HAVE THREE OPTIONS:
1. DISPUTE THE TICKET AND GO TO TRIAL
(if you go to trial, seriously consider hiring a lawyer)
2. PLEAD TO THE CHARGE OF A FIVE POINT MOVING VIOLATION
3. ENTER THE DISTRACTED DRIVER EDUCATION PROGRAM
IF YOU ENTER THE DISTRACTED DRIVER EDUCATION PROGRAM:
PLEAD TO LESSER CHARGE – 4 POINT VIOLATION + $283
INSTALL CELL CONTROL DEVICE IN YOUR CAR FOR 90 DAYS
TO MONITOR CELL PHONE/ ELECTRONIC DEVICE USAGE
PROVIDE THE COURT WITH THE REPORT
If successful, plea replaced with NO point violation.
If not successful, 4 point violation stands.
